Fort Lauderdale Bicycle Accident Attorney

Bike Accident Statistics

Two percent of the 6.2 million traffic accidents that occur in the U.S. every year involve bicyclists, according to the National Highway Traffic Safety Administration. That equates to nearly 125,000 accidents annually, or 340 accidents every day. As a result of these accidents, 50,000 people are injured, and 700 are killed. This high rate of injury is due to the exposure and lack of protection afforded a bicyclist. A rider fully outfitted with the maximum safety equipment will still only be protected by a helmet, goggles, and impact pads on their knees and elbows. In the event that the rider is struck by a vehicle or run off the road, there is little chance that their safety gear will help in the avoidance of serious injuries.

Weinstein & Scharf, P.A. has provided legal support to many individuals injured in bicycle accidents, and we understand the danger bicycle riders face daily. Bicyclists are often regarded as an obstruction or a nuisance, and so are given less consideration or attention by motorists than a person in another vehicle. If you have been injured in a bicycle accident, we will help you defend your rights as a rider.

Common Bicycle Accidents in Fort Lauderdale, FL

Most of the time, when a bicyclist is injured in an accident, it is because of a driver's fault. According to statistics released by the U.S. Department of Transportation:

  • 7.3% of accidents involved a bicyclist turning into a driver's path
  • 8.6% of accidents involved a driver hitting a cyclist by misjudging the space needed to pass
  • 11.7% of accidents involved bicyclist errors in failing to yield by a driveway or midblock location
  • 16.8% of accidents involved crosswalk or intersection errors by a bicyclist
  • 21.7% involved intersection or crosswalk errors by a driver

Common accidents involving a driver and bicyclist include: the "right cross," being hit by a car door, the "crosswalk slam," being hit by a car while riding against traffic, being run into as a car attempts to turn right at a red light, the "right hook," the "left cross," and the rear end. The right cross is the most common accident and involves a car pulling out of a parking lot, driveway or side street and a bicyclist getting struck.

Often, a driver will open their door in front of a bicyclist, and before the bicyclist can swerve he/she careens into the car door. The "crosswalk slam" is when a cyclist crosses a crosswalk and a driver turns right and into the bicyclist. When a cyclist rides against traffic it is all too easy to get into an accident. A car can easily make a right turn from a side street, parking lot or driveway and into the rider.

When a cyclist stops at a red light, it is all too easy to be in the blind spot of a motorist. As a result, the driver can turn right and right into the cyclist. The "right hook" is when a car passes a cyclist and tries to turn right directly in front of the cyclist. The "left cross" is when a car turns left and into a cyclist. Another common accident is when a rider attempts to go around an obstacle or car and is hit from behind.

Right of Way on a Bicycle

On the road, you, as a bicyclist, are afforded the same rights and responsibilities as those operating motor vehicles. You must still adhere to traffic laws and allow pedestrians the right of way. By the same token, you deserve to have your bike lanes recognized by motorists, and you deserve to have larger vehicles give you the right of way as you cross the street. If your rights have been violated while on a bicycle and you have suffered injury as a result, you need to contact a lawyer who can fight for the compensation for damages you are entitled to.
