Our GOAL: Maximize Your Recovery 70+ Years of Experience & Millions of Dollars Won for Our Clients

How Much Is Your Case Worth?

Determining the Value of an Accident Claim

Perhaps the most common question we are asked by our clients at Weinstein & Scharf, P.A. is, "How much could I get if I win my case?" This makes sense. After all, our job as personal injury attorneys is to help the client maximize the value of his or her accident claim. The fact is that every case is different, and there is no way to accurately predict the amount that you will receive if you prevail in your case. Our attorneys have helped clients receive countless settlements and jury verdicts ranging into the hundreds of thousands and even several millions of dollars, but we do not guarantee results in any case. There are, however, guidelines which can be used to estimate the amount that you are entitled to receive.

Recoverable Damages in a Personal Injury Case

The Florida Supreme Court publishes a guide titled Standard Jury Instructions – Civil Cases, which is used for personal injury cases that go to a full jury trial. We are often able to settle with insurance companies out of court, but the same guidelines can apply in this situation. Section 500 of the Instructions describes in considerable detail the various types of damages which can be awarded to a plaintiff.

Economic Damages

The goal of a personal injury claim is to make it possible for you to receive sufficient compensation to restore you as nearly as possible to your pre-accident condition. The settlement or award of damages should be large enough that you are not forced to shoulder the significant financial burden of the accident.

You can claim full compensation for all of your medical expenses associated with the injury, including:

  • Emergency treatment
  • Hospitalization
  • Surgery
  • Ongoing rehabilitative care
  • Medication
  • Medical equipment and home modifications to accommodate the injury
  • Economic damages can also include compensation for all of the income you have lost during your recovery, as well as for any reduction in your future earning power.

Non-Economic Damages

In addition to compensation for your financial losses, you have a right to demand damages for the pain and suffering you have been forced to experience. Your settlement can include consideration for disability or physical impairment, disfigurement, mental anguish and loss of capacity to enjoy life. Accurately determining this type of compensation can be difficult as it is subjective in nature, but through testimony from you and your family members regarding your symptoms, chronic pain and emotional well-being, we can seek to estimate an amount that is fair.
