A New York City McDonald’s cook who had to fend off an attack by two female customers with a steel pole plans to sue the fast food restaurant.

On October 13, two women tried to pay with a $50 bill at the New York City McDonald’s where 31-year-old Rayon McIntosh worked as a cook. When McIntosh questioned whether the bill was counterfeit, the women cursed at him, spat on him and lunged over the counter to physically attack him.

McIntosh used a 3-foot metal pole to fend off the attack, fracturing the skull of one of the women.

He was arrested for felony assault and remained in jail for seven weeks following the incident, but was released on Friday after a grand jury refused to indict him.

McIntosh said he plans on filing a civil suit against McDonald’s for failing to hire a security guard to protect employees.
